Police must be careful not to violate an individual’s rights and, in most instances, must obtain consent. New Jersey’s search and seizure laws protect a person against unreasonable searches and seizures.
For law enforcement to search your body or enter your property (e.g. home or car), they must have probable cause. There are some exceptions. If you find yourself in a situation where police did not have a warrant, or you feel your rights were violated, contact an attorney right away.
New Jersey does allow for expungements for crimes, but certain criteria must be met:
- Indictable offenses (felonies) must wait five years, but in some cases, people meet eligibility to file after four years
- A disorderly person’s offense (misdemeanors) must wait five years, but in some cases, people meet eligibility to apply after three years
- Municipal ordinance violations must wait two years
- Clean slate expungement has a waiting period of 10 years
- Juvenile criminal records go away on their own after three years but can potentially be expunged sooner
